The SIXT-Group is one of the world's leading mobility providers and creates tailored mobility solutions for business and corporate customers as well as for private travelers around the world. SIXT SE, the ultimate parent company of the SIXT-Group, is, due to its seat and place of management in Germany, subject to an unlimited tax liability in Germany on its world-wide income and has to fulfill obligations with regard to direct and indirect taxes.
In addition, group companies of SIXT SE are subject to tax in Germany and abroad with their income and do also have to fulfill obligations with regard to direct and indirect taxes.
The following tax strategy is published for the following UK companies of the SIXT-Group:
This strategy is published in accordance with paragraph 19(4) of Schedule 19 of the 2016 Finance Act. It refers to the year ended 31 December 2017.
The obligation to fulfill the fiscal requirements generally lies with the representatives that may further delegate these obligations. In return, the delegating person receives an obligation to supervise the delegated tasks. A sufficient number of qualified external (tax) advisors is engaged in order to fulfill the fiscal obligations in the UK.
Moreover, the SIXT-Group has an internal control system for taxes (so-called ICS Tax). The ICS Tax aims at the compliance with all tax rules relevant for the SIXT-Group. Errors that occur anyway shall be detected and corrected in a timely manner. Through this, the Board of Directors of SIXT SE wants to ensure a positive compliance culture throughout the SIXT-Group, including the area of taxes.
The tax position of the SIXT-Group is a substantial cost factor that needs to be managed actively and efficiently. However, this has to be achieved while complying with the requirements determined by the applicable tax laws.
Hence, all activities of the SIXT-Group are subject to a check of their legality and legitimacy. Accordingly, SIXT will only take those actions, that are in compliance with the applicable tax laws. Therefore, the SIXT-Group refrains from purely tax driven transactions without a bona fide commercial reason. This has to be distinct from actions, which are approved by the jurisdiction or are provided for by law (e. g. forming a tax group). Given the complexity of and fast changes in tax law, SIXT might, especially where a transaction is complicated or contains a cross-border element or in case of ambiguity of tax laws, seek help from external tax advisors or contact the competent authorities in order to comply with the applicable tax law. This approach to tax planning also applies to the UK.
The SIXT-Group aims to comply with all fiscal obligations within the course of its group-wide business activities. Especially when it comes to cross-border transactions or an otherwise complex situation, the respective companies of the SIXT-Group might seek help from external tax advisors or confirmation from the tax authorities (e. g. in the form of an advance ruling) to ensure that this is achieved.
A fair and good cooperation with tax authorities is important to the SIXT-Group. Therefore, SIXT engages in an extensive communication with tax authorities worldwide and therefore also in the UK in order to ensure a common understanding of the tax treatment of various business transactions. In case interpreting the law leaves SIXT with significant doubts or in case tax risks are identified, SIXT might seek confirmation from the tax authorities (e. g. in the form of an advance ruling) or simply inform the tax authorities about the legal position the respective SIXT-company has taken on a specific question.
Within the course of its business activities, the SIXT-Group acknowledges its obligation to pay its fair share of taxes and duties in accordance with the respective tax law and thus contribute appropriately to the budget.
Being not compliant with fiscal obligations may have personal consequences for the respective person.
The SIXT-Group has the aim to establish and maintain an organizational structure, which allows the avoidance of errors or - in case they occur anyway - to correct them as soon as possible. In order to achieve this, the SIXT-Group has implemented a set of rules which are part of its internal control system.
The SIXT-Group supports global standards regarding tax transparency and the coordination of national tax systems.
As far as intra group business transactions exist, intercompany charges need to be established in accordance with the applicable transfer pricing rules.
In this context, an appropriate documentation has to be prepared.
